Any provider touching personal data is a processor and needs a Data Processing Agreement covering purpose limitation, sub-processor disclosure, breach notification timelines and deletion on termination. GDPR compliance also requires privacy-by-design, data minimisation, encryption, access controls, auditability, and clear data governance throughout the AI agent lifecycle. Where delivery sits outside the EEA, that means Standard Contractual Clauses plus a documented transfer impact assessment.
